EU Directives

FE institutions are required to comply with EU tendering directives and it is our job, as your purchasing consortium, to fully inform our members of EU purchasing requirements and to encourage all members to fully comply with the Directives. Part of the offering of the consortium is to tender contracts through the EU to give full cover to our members but we are aware that some members utilise quotations from our EU tendered suppliers and then offer contracts elsewhere. All should be aware that this does not in any way constitute compliance with the Directives.

The CPC will be providing as much information as we can regarding EU procurement directives in this part of our website. Please do utilise the offer of professional advice from the CPC as we are happy to assist our members in any way we can.

EU Discussion Paper: Remedies Directive

This EU Discussion Paper gives some valuable information from the Government in respect of some aspects of compliance that may be tightened up by the Commission. Particularly interesting are the references to Independent Compliance Authorities (ICA) in section 3.3. If a body such as this is introduced in the UK, we suspect it will have a major effect on the FE sector and many of its current attitudes to purchasing.

Guidelines for 'Mini Competition' Within An Existing Framework Agreement

Under the new EU regulations in respect of framework agreements, if there is more than one supplier, you are, at times, required to carry out a mini competition (tender).

OJEU Regulations & Penalties for Non-Compliance

Compliance procedures ensure that the EU procurement rules are properly enforced. National courts or tribunals in each Member State are empowered to take certain measures, including interim measures and the European Commission can commence proceedings against the UK Government under the EC Treaty if any contracting authority breaches the rules. Buying Social: A Guide to Taking Account of Social Considerations in Public Procurement
